This Privacy Policy (hereinafter the “Policy”) explains how Published, Inc., a Delaware corporation, USA (hereinafter referred to as the “Company”, “we”, “us”, “our” in all grammatical forms), with its registered address at: 1111B South Governors Ave STE 47043, Dover, DE, 19904, US, collects information about you (your personal data).

This Privacy Policy applies to all users of Published!, including unregistered visitors, registered customers, and members of their teams (hereinafter collectively referred to as “Users”, “you”, or “your” in all grammatical forms), as well as to all services of the Company, including our websites (in particular, published.ua, published.software, hereinafter collectively referred to as the “Platform”), the Published! product, and related services.

This Privacy Policy is not intended to replace the terms of any agreement that we have entered into with you, nor to replace any rights that you may have under other applicable personal data protection laws.

In this Policy, you will learn what personal data processing operations may be carried out within the scope of our activities and the procedure for such processing. However, if you do not find answers to all your questions, you may contact the Company by sending an email to [email protected].

By visiting and using the Platform and Published!, you accept this Privacy Policy and authorize the Company to process information about you (personal data) in accordance with the purposes specified in this Policy.

By visiting the Platform and using Published!, you confirm that you have sufficient legal capacity and authority to consent to this Privacy Policy, including consent to the processing of your personal data under the terms set forth herein.

If you do not agree with the terms of this Policy, do not use the Platform and Published!, and do not take any actions that may indicate your acceptance of the terms of this Policy.

What data do we collect?

Data when ordering a Published! presentation (demo request): first and last name, email address, phone number.

Data when creating an Account: first and last name, email address, phone number, company name, information about the user’s role in the team/position.

Payment data. Payments are processed by third-party payment providers (Stripe, PayPal, etc.). The Company does not store full payment details (payment card numbers, CVV, etc.). We may receive transaction identifiers, payment statuses, and limited payment metadata.

Platform usage data: we collect information about your computer, phone, tablet, or other devices that you use to access the Platform. This device information includes your connection type and settings when installing, accessing, updating, or using our Services. We also collect information through your device about your operating system, browser type, IP address, referring/exit URLs, device identifiers, and crash data. We use your IP address and/or country settings to approximately determine your location and provide you with a better user experience. The amount of information we collect depends on the type and settings of the device you use to access the Platform.

Customer Content. The Company stores and processes Customer Content under the terms set out in the Software Access Services Agreement. Access to such content by the Company’s team may be carried out solely for the purposes of technical support, troubleshooting, or security assurance.

Automatically collected data. Cookies and other tracking technologies: the Company and our third-party partners, including advertising and analytics partners, use cookies and other tracking technologies to ensure functionality and recognize you when using the Platform and/or Published! and across different devices.

The Company does not process personal data concerning racial or ethnic origin, political, religious, or philosophical beliefs, membership in political parties or professional unions, criminal convictions, or data concerning health, sexual life, biometric, or genetic data.

Purposes of personal data processing

Personal data is processed for the following purposes:

  • Providing information about Published! and the terms of its use;
  • Providing and administering access to Published! and related services;
  • Payment processing and accounting;
  • Communication with customers;
  • Improving the functionality and stability of the Platform and Published!;
  • Analytics of the use of Published! and related services;

  • Compliance with legal requirements.

Legal grounds for personal data processing

Personal data is processed on the basis of:

  • Conclusion and performance of the Software Access Services Agreement (Public Offer);
  • Legitimate interests of the Company;
  • User consent (in cases provided by law);
  • Fulfillment of legal obligations.

Storage of personal data

The Company is the controller of your personal data.

To ensure the security of personal data, your personal data is stored on the Company’s servers in the European Union and the United States of America, and may also be stored on servers of third parties.

We may disclose information about you to third parties:

  • Employees, contractors, consultants, and other persons of the Company who need access to such information to fulfill the Company’s obligations (including providing access to the Platform and Published!);
  • Payment service providers;
  • Analytics providers;
  • Email marketing services;
  • Hosting providers;

  • To protect the rights, property, and/or safety of the Company and/or other persons.

We may entrust the processing of your personal data to third parties under a relevant agreement.

In addition to the purposes stated above, we may process your personal data for various purposes, including:

  • Development of new software and improvement of existing software provided to you;

  • Troubleshooting software issues that may arise during the provision of services and/or use of the Platform and Published!;
  • Ensuring, maintaining, and improving the operation of the Platform and Published! and the user interface;
  • Collecting feedback and analyzing user satisfaction to improve the quality of our services;
  • Ensuring security, preventing fraud, and protecting against unauthorized access;
  • Sending you notifications, making calls, or communicating with you in other ways;
  • Providing news and information about the Platform and Published! and/or the Company’s activities that we believe may be of interest to you;
  • Personalizing the user experience, including saving settings when using the Platform and Published!.

The Platform may contain links to other websites. When following links to other websites, this Policy does not apply to such websites. Therefore, the Company recommends reviewing the privacy and personal data policies of each website before providing any personal data.

Personal data retention period

Personal data is stored for no longer than necessary for the purposes of its processing, but no longer than 5 years from the date of termination of contractual relations, unless a longer period is required by applicable law.

Access to personal data

The procedure for access to personal data of third parties is determined by the terms of consent provided by such third parties to the personal data controller or in accordance with the requirements of the law.

You have the right to obtain any information about yourself from any entity involved in personal data relations, provided that you submit a request by email to [email protected] with the subject line “access to personal data”, indicating your last name, first name, patronymic, place of residence (or stay), and details of the identity document of the individual submitting the request, except in cases established by law.

Access to your personal data is provided free of charge.

A request is reviewed within 10 business days from the date of receipt. The request is fulfilled within 30 calendar days, unless another period is provided by applicable law.

The Company takes reasonable measures to protect personal data from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction.

Personal data of minors

The Platform and Published! are not intended for use by minors.

We do not collect personal information from minors. If we learn that a minor has provided us with their data or violated this condition, we will delete the account and all related information.

The Company reviews the request within 10 business days and provides a response to the email address from which the request was sent.

You understand that deletion of personal data during the term of the Software Access Services Agreement results in termination of the use of the Services and Paid Services.

Changes to the Privacy Policy

The Company may update this Privacy Policy from time to time. If we make changes, we will notify you by updating the date at the top of this Policy. We recommend that you review the Privacy Policy whenever you access the Platform to stay informed about how personal data is processed.
